Decision of the Svea Court of Appeal, 29 October 2002, Case No. Ö 7192-01
The appellant sought enforcement of a Danish arbitral award rendered pursuant to a bilateral investment treaty (BIT). The respondent resisted enforcement of the award, alleging that the appellant was not an investor as required by the BIT and that the court should stay enforcement proceedings until the conclusion of challenge proceedings in Denmark. The Svea Court of Appeal declined to review whether the appellant was an investor under the BIT and concluded that no policy grounds existed to stay enforcement pending the Danish court proceedings. The court granted enforcement and rejected the challenge.
