Judgment of the Supreme Court of Sweden, 12 November 2001, Case No. Ö 1245-01/NJA 2001 s. 738
Summary: The appellant sought recovery of costs incurred through court proceedings to enforce a foreign arbitral award. The Supreme Court of Sweden noted that, although the Swedish Arbitration Act does not expressly allow a party to recover costs associated with enforcement proceedings, the Swedish Code of Judicial Procedure allows a party to recover its litigation costs from the counterparty. Because the enforcement proceedings took place in the Swedish courts, to which the Swedish Code of Judicial Procedure applies, the court granted the request and ordered the counterparty to compensate the appellant’s costs.
